1. Acceptance of Terms
By accessing and using icallya ("the Service"), you accept and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you must not use the Service.
These terms constitute a legally binding agreement between you and icallya. We reserve the right to modify these terms at any time, and continued use of the Service after changes constitutes acceptance of the modified terms.
2. Service Description
icallya provides international calling services that allow users to make voice calls to phone numbers worldwide using Voice over IP (VoIP) technology. The Service operates on a prepaid credit basis, where users purchase credits and are charged based on call duration and destination.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice. We do not guarantee uninterrupted or error-free service.
3. Account Registration and Security
3.1 Account Requirements
- You must be at least 18 years old to use the Service
- You must provide accurate and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
3.2 Account Termination
You may terminate your account at any time. We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or for any other reason at our sole discretion.
4. Prohibited Uses and Unlawful Activities
The Service must NOT be used for any unlawful purpose or in violation of any applicable laws.
Violations may result in immediate account termination, forfeiture of credits, and reporting to law enforcement authorities.
4.1 Strictly Prohibited Activities
You expressly agree NOT to use the Service for:
- Illegal Activities: Any purpose that violates local, state, national, or international law
- Harassment or Threats: Making harassing, threatening, abusive, or intimidating calls
- Fraud or Scams: Conducting fraudulent activities, scams, phishing, or social engineering attacks
- Spam or Robocalls: Making unsolicited commercial calls, spam, or automated robocalls without proper authorization
- Impersonation: Impersonating any person or entity, or falsely stating or misrepresenting your affiliation
- Emergency Services Abuse: Misusing emergency service numbers or making false emergency reports
- Telecommunication Fraud: Any form of toll fraud, traffic pumping, or other telecommunications abuse
- Hacking or Unauthorized Access: Attempting to gain unauthorized access to any systems or networks
- Circumventing Restrictions: Bypassing sanctions, embargoes, or other legal restrictions
- Intellectual Property Violations: Infringing on copyrights, trademarks, or other intellectual property rights
- Distribution of Malicious Content: Transmitting viruses, malware, or any harmful code
- Privacy Violations: Recording calls without proper consent where required by law
- Minor Exploitation: Any activity related to child exploitation or abuse
4.2 Commercial Use Restrictions
- Telemarketing must comply with all applicable Do Not Call regulations
- Bulk calling requires prior written authorization
- Automated dialing systems must comply with TCPA and similar regulations
4.3 Network Abuse
- Excessive usage that disrupts service for other users
- Attempting to overwhelm or crash the Service infrastructure
- Using the Service to test, probe, or attack security measures
5. Payment Terms
5.1 Pricing and Billing
- All charges are in USD unless otherwise specified
- Call rates vary by destination and are available on our rates page
- Charges are deducted from your prepaid credit balance in real-time during calls
- You are responsible for monitoring your credit balance
- Calls may be disconnected if your credit balance is insufficient
5.2 Refund Policy
- Credits purchased are generally non-refundable
- Refunds may be issued at our sole discretion for technical errors or service failures
- Refund requests must be submitted within 30 days of purchase
- Accounts terminated for violation of these terms forfeit all remaining credits
5.3 Payment Processing
All payments are processed securely through Stripe. We do not store your payment card information. By making a payment, you agree to Stripe's terms and conditions.
6. Service Quality and Limitations
6.1 No Emergency Services
This Service does NOT support emergency calls (911, 112, etc.)
Do not rely on this Service for emergency communications. Use a traditional phone line or mobile phone for emergency calls.
6.2 Service Availability
- Service availability depends on your internet connection quality
- Call quality may vary based on network conditions
- Some destinations may be unavailable due to legal or technical restrictions
- We may block calls to certain high-fraud destinations
6.3 Call Recording
Calls may be recorded for quality assurance, fraud prevention, and legal compliance. You are responsible for complying with all applicable laws regarding call recording and consent in your jurisdiction and the jurisdiction of the called party.
7. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are owned by icallya or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE LAST 12 MONTHS
- WE ARE NOT RESPONSIBLE FOR THIRD-PARTY SERVICES, INCLUDING TWILIO AND STRIPE
- WE ARE NOT LIABLE FOR SERVICE INTERRUPTIONS, DATA LOSS, OR SECURITY BREACHES
9. Indemnification
You agree to indemnify, defend, and hold harmless icallya, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms of Use
- Your violation of any laws or regulations
- Your violation of any rights of third parties
10. Dispute Resolution
10.1 Informal Resolution
Before filing a claim, you agree to contact us to attempt to resolve the dispute informally. Contact us at support@icallya.com with a description of the dispute.
10.2 Arbitration
If informal resolution fails, any disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, rather than in court, except where prohibited by law.
10.3 Class Action Waiver
You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions or class-wide arbitration, except where such waivers are prohibited by law.
11. Governing Law

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and icallya regarding the Service and supersede all prior agreements and understandings.
